Summary
This project is to enhancing professional ability of volunteer lawyers for environmental protection, particularly the environmental law skills and environmental protection knowledge, thus uprising the professional level of these volunteer lawyers on environmental public interested litigation & law service. This project will establish series activities including (1) set up a work & lecture team (2) edit training tutorial (3) recruit volunteer lawyers (4) establish training programme. Through this proposed training programme for volunteer lawyers for environmental protection, the trainees will be proficient in both of environmental related law and regulations and environmental protection knowledge. Ultimately, this project will contribute by mobilizing the participation from the legal professional to engage in the environmental legal litigation, and therefore mitigating the conflict by environmental pollution caused law case and helping the victim caused by environmental pollution using the legitimate ways to defend their environmental rights.
Key Activities
ACEF will call for volunteer lawyers who are enthusiastic about environmental protection and support environmental protection and willing to work for it to participate in the environmental law training programme. The key activities are as follows:
Step 1: Preparation
This stage includes preparing relative information for the training project, establishing training team and finalizing the training plan. There will be 5 experts and 5 working staff in this training team. We will organize 2 seminars to discuss training objective and training content, and then finalize the training plan.
Step 2: Recruiting voluntary lawyers and voluntary law firms
Lawyers will sign the cooperative agreement with the Environmental Legal Service Centre of ACEF in the name of individual and become the voluntary environmental right defence lawyers. Law firms will sign the cooperative agreement with ACEF in the name of organization and become the volunteer environmental law firms. All the lawyers working in voluntary environmental right defence law firms will become volunteer lawyers of ACEF. We will report recruitment information on the website of ACEF (www.acef.com.cn) and Legal Daily (http://www.legaldaily.com.cn/). We will choose 90 volunteer lawyers and 10 law firms from all the candidates.
Step 3: Training
The environmental law service centre will establish 6 days intensive courses to these recruited trainees. The training content will focus on environmental legal system and environmental right defence cases. The training experts are following: Mr. Sun Youhai, Director General of Legislative Department, the Environment Protection and Natural Resources Conservation Committee of National People’s Congress (NPC), Mr. Hu Zhanshan, Director of Department of Lawyers and Notary, Ministry of Justice, Mr. Li Hengyuan, Deputy Secretary General of ACEF, Mr. Wang Jing, Professor, Law School of Peking University, Ms. Xu Kezhu, Deputy Professor of China University of Political Science and Law.
The training, with rich content and various forms, comprises current situation of environmental legal law, judicial identification, and application of environmental standard, settlement mechanism of environmental dispute, technique of evidence selection, theory study and discussion on representative cases.
Step 4: Organizing 3 seminars on representative cases
After training, we will invite 10 relative experts and scholars to discuss with lawyers on some representative cases to deepen and consolidate the training achievement, then write law proposals and submit it to relative legislative department and judicial department.
Step 5: Publishing training course books and videos
We will publish 1000 training course books and 1000 videos on the basis of training content.
Step 6: Project popularization
We will cooperate with mass media to promote the awareness of the public through widely propaganda campaign. ACEF has a good relationship with about 100 media organizations, including Xinhua News Agency, China National Radio, and China Central Television. From the experience of the programme, ACEF will cooperate with the Legal Daily to set up a special column to report the achievement of this training programme.
